ANDREW HURWITZ -- INVOLVED WITH ROE V. WADE

Activist, divisive, unprecedented: these are the words legal commentators use to describe Justice Harry Blackmun's infamous opinion in Roe v Wade, the 5-4 decision that tortured the text of the Constitution into recognizing a right to abortion. A growing number of lawyers, judges, and medical professionals on both sides of the issue (not to mention a majority of the American public) think the ruling is indefensible. But not Andrew Hurwitz, Obama's nominee to the Ninth Circuit Court of Appeals. As a young law clerk, Hurwitz helped draft a lower court ruling that played a crucial influence in informing Blackmun's landmark decision in Roe. Senate Majority Leader Harry Reid and President Obama are nominating Hurwitz.

Confirmation votes are scheduled for this coming Monday in what will be nothing less than a proxy vote for Roe. Even House members like Rep. Ted Poe (R-Texas) understand the importance of this vote and are taking the unusual step of drafting a letter from the House to the Senate urging the other chamber to vote "no" on Hurwitz. Contact both of your senators today. As a self-described architect of the decision that cost America over 55 million lives, Hurwitz doesn't deserve a promotion.
